Snorkel AI, Inc. (“Snorkel AI”, the “Company”, “we,” “us,” or “our”) respects and values your privacy. This Privacy Policy explains our online and offline information practices, the kinds of information we may collect, how we intend to use and share that information, and how you can opt-out of a use or correct or change such information. This Privacy Policy is incorporated by reference into our Website Terms of Service (“Terms of Service”). 1. Scope

This Privacy Policy applies to information that we process from or regarding our current, prospective, and former customers, users, visitors, guests, business partners, and employees, in the course of our business, including on our website (our “Website”), through our forms, applications and platforms (including the platform accessed by Expert Contributors (the “Platform”)), by phone, texts, or in-person, and any other offerings that link to this Privacy Policy (collectively, the “Services”). This Privacy Policy does not apply to information collected by any third party, including through any application or content (including advertising), that may link to or be accessible from or through the Services.

2. Information We Collect About You

We collect limited categories of personal information based on your relationship with us. The categories of information identified in this Privacy Policy will be referred to as “personal information.”

  • Identifiers, e.g. real name, alias, account name
  • Contact Information, e.g., physical and mailing address, email address, phone number.
  • Account Information, e.g. usernames and account numbers.
  • Internet or other similar network activity, e.g. internet or other electronic network activity information such as information regarding your interaction with the Services.
  • Communications, e.g. the content of mail, email, or text messages you send to us or we send to you.
  • Sensory data, e.g. audio, electronic, visual, or similar information, including audio recordings of customer service calls.
  • Demographic Information, e.g. age, race, marital status, mental or physical disability, sex or gender, sexuality, employment status.
  • Professional or employment-related information, e.g. current or past employment history, performance evaluations, and income and salary details.
  • Education information, e.g. current or past education or credentialing information.

Some or all of the types of personal information listed above may be considered “sensitive” personal information according to some state laws.

While personal information is broadly defined, other categories are specifically excluded from this definition including:

  • Publicly available information, meaning information that is available from federal, state, or local government records.
  • Pseudonymized and de-identified information or aggregated and de-identified information that cannot be reasonably linked to an individual.

3. Information We Collect From Expert Contributors

If you engage with us as an Expert Contributor, including but not limited to domain specialists, data scientists, annotators, researchers, engineers, or contractors providing subject matter expertise or dataset curation, we may collect additional categories of personal and professional information. This may include:

  • Identifiers, e.g. real name, alias, account name
  • Contact Information, e.g., physical and mailing address, email address, phone number.
  • Employer or Affiliations, e.g., current employer, institutional affiliation, or contracting entity (if applicable).
  • Account Information, e.g., usernames, passwords, account credentials, or account numbers.
  • Professional or Employment-Related Information, e.g., job title, current or past employment history, professional certifications or licenses, performance feedback, and income or compensation details.
  • Education Information, e.g., academic degrees, schools attended, technical certifications, or areas of subject-matter expertise.
  • Expert Contributor Data, e.g., curriculum vitae (CV), professional bios, links to public profiles (e.g., LinkedIn, GitHub, ORCID), labeling functions, heuristics, or other programmatic contributions; annotation decisions; feedback on datasets; prompt or model evaluation input; and attribution information (e.g., name, title, image) where agreed.
  • Communications, e.g., the content of emails, messages, or other interactions sent to or received from us, including editorial feedback or platform correspondence.
  • Internet or Other Electronic Network Activity, e.g., information regarding your interactions with our services, such as IP address, browser type, access logs, usage behavior, and device identifiers.
  • Geolocation Data, e.g., general location derived from IP address or device settings.
  • Sensory Data, e.g., video recordings (e.g., content meetings) or visual data (e.g., profile photos submitted for publication).
  • Demographic Information, e.g., age, gender, race or ethnicity, marital status, disability status, sexual orientation, or employment status, where voluntarily disclosed or collected for compliance, research, or diversity reporting.
  • Legal, Financial, and Operational Information, e.g., contributor agreements, tax or payment documentation, intellectual property contributions, activity logs, revision history, audit trails, and attribution details for work products submitted or delivered under contract.

Some or all of the types of personal information listed above may be considered “sensitive” personal information according to some state laws.

While personal information is broadly defined, other categories are specifically excluded from this definition including:

4. How We Collect Information About You

Direct Collection

We collect personal information from our provision of the Services or operation of our business, including:

  • Information you provide us directly in connection with the Services, including information you provide us by phone, email, text, in-person, through our Website (including by filling in forms on our Website, or other forms or applications on third party websites and services, if those forms or applications link to this Privacy Policy).
  • Information you provide when applying for a job at Snorkel AI or in connection with your employment with Snorkel AI, either directly to Snorkel AI or to our third party service providers (e.g., recruiters or recruiting platforms, HR or payroll management services).
  • Information we lawfully obtain from our third party service providers and public sources.

Indirect Collection

We collect personal information from third parties when you use the Services, including:

  • Information we receive from our integration, data source, or technology partners.
  • Information we receive about you or other users from our network of business partners or third party services.

Automatic Collection

We use certain automatic data collection and instrumentation technologies to gather information about your device, browser, and interactions with our Services. These technologies help us understand how users, employees, or Expert Contributors engage with our Services and support our efforts to improve performance, security, and user experience. The types of information we may collect automatically include:

  • Information about your computer hardware and software when you visit our Websites, Platform, use our Services, or visit other sites or services that link to this Privacy Policy. This information can include your IP address, browser type, domain names, internet service provider (ISP), and the files viewed on our websites (e.g., HTML pages, graphics, etc.), the files viewed on your operating system, access times and referring website addresses.
  • Information about your online activities over time and across third party websites or other online services (behavioral tracking).
  • Information collected in connection with analytics technologies, such as Google Analytics and other similar technologies, that permit us to learn more about how visitors use our online Services. For more information about how Google Analytics uses and processes data, please visit https://www.google.com/policies/privacy/partners/.
  • Information stored in web-based technologies like cookies, pixel tags, log files, or web beacons, including browser type, portions of the online services visited, time spent on the online services, pages visited, referring URLs, links you click on, and other traffic and usage data. If you are an Expert Contributor, we also log the details of your visits to our Platform and information generated in the course of using our Platform, such as device type, mouse movements, clicks, page visits, text entered, how long you spent on a page, and other details of your actions on our Platform, and record your sessions on a third-party tool.
  • Information that indicates your general location, including your IP address.

We may share information collected from automatic means with trusted third-parties to analyze and organize any collected data on our behalf and at our direction.

You can control the use of cookies on your device at any time by changing your preferences or options in your browser settings. Each browser provides different mechanisms for managing cookies. You can usually find these settings in the “Options” or “Preferences” menu of your browser; otherwise, look at your browser’s help menu to determine the best way to modify your browser’s cookie storage. You can also block, disable, or delete the cookies that are stored on your device. However, blocking, disabling, or deleting cookies may limit your ability to view all the pages on our online Services.

Third Party Use of Cookies and Other Tracking Technologies

Some content or applications related to the Services are served by third-parties, including content providers, service providers, and application providers. These third parties may use cookies, alone or in conjunction with web beacons or other tracking technologies, to collect information about you when you use our Services. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

Do Not Track Signals

Do Not Track (DNT) is an optional browser setting that allows you to express your preferences regarding tracking by advertisers and other third-parties. We currently do not respond to DNT signals.

5. How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

  • To provide, operate, maintain, test, develop, and improve the Services.
  • To authenticate users, manage accounts, and control access.
  • To communicate with you about the Services, including to notify you about changes to the Services, the Terms of Service, or this Privacy Policy.
  • To diagnose and fix technological problems with the Services.
  • To personalize user experience and content.
  • To develop new products and services.
  • To provide information that you request from us.
  • To fulfill any other purpose for which you provide it.
  • To provide you with employment.
  • To recruit, evaluate, and communicate with job applicants and candidates for employment or contracting engagements, including processing applications and responding to requests and sending promotional information.
  • To maintain our directory of candidates and contractors available for future job openings or opportunities.
  • To provide the Platform and our services to Expert Contributors to perform services for us or our clients.
  • To provide human resources, employment, benefits administration, and related business purposes.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us.
  • To resolve disputes, to protect the rights, property, or safety of Snorkel AI, our Services, customers, employees, business partners, or the public, and to enforce any legal terms that govern your use of the Services or our other services and products.
  • To protect the rights, property, or safety of Snorkel AI, our personnel, our clients, or others, including to maintain network and information security, for fraud prevention, to report suspected criminal acts, and to enforce our policies, terms of use, or other legal rights.
  • To comply with our legal and regulatory obligations.
  • To evaluate or conduct a merger, sale, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us is among the assets transferred.
  • For any other purpose with your consent.

6. Disclosure of Your Information to Third Parties

Snorkel AI treats your personal information with care and confidentiality. We only pass personal information to our affiliates and third parties to the extent described here and within the scope of the purpose limitation under data protection law.

We may disclose aggregated information about individuals, and information that does not identify any individual, without restriction.

We may disclose personal information that we collect or you provide as described in this Privacy Policy to the following third parties:

  • To our subsidiaries and affiliates for our business purposes.
  • To our contractors, service providers, and other third parties we use to support our business.
  • To our professional advisors who are under legal obligations to keep the personal information confidential.
  • To our clients so they can evaluate whether a candidate or Expert Contributor is a good fit for their current or prospective job requisitions.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by the Company is among the assets transferred.
  • As necessary to fulfill the purpose for which you provide it.
  • As necessary to comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Snorkel AI, our customers, employees or others.
  • Any other third party with your consent.

We may also disclose your personal information:

  • To comply with any law, court order, or legal process, including to respond to any government or regulatory request (including, without limitation, to our lawyers and tax consultants).
  • To enforce or apply our terms of use and other agreements.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers, our employees, or others.
  • With your consent.

We do not sell and, in the past twelve (12) months, have not sold personal information.

7. Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. To learn how you can manage your Flash cookie settings, visit the Flash player settings page on Adobe's website. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.
  • Promotional Offers from Snorkel AI. To opt-out of promotional communications, click “Unsubscribe” in any promotional email or contact us at privacy@snorkel.ai.
  • Third Party Advertising. We may partner with third party ad networks to display advertising on our website or to manage our advertising on other sites. These third parties may use cookies and web beacons to collect information about your activities on this and other websites to provide you targeted advertising based upon your interests. We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI's website. Please note this does not opt you out of being served advertising you will continue to receive generic ads.

8. California Privacy Rights

If you are a California resident, you may have the following rights (free of charge) under the California Consumer Privacy Act (“CCPA”) and the California Privacy Rights Act (“CPRA”) with respect to your Personal Information to the extent these laws are applicable to Snorkel AI:

  • Initial Disclosure: As described above, Snorkel AI collects various categories of personal information when you use the Services, including identifiers, commercial information, internet or other electronic network or device activity information, geolocation data, and professional information. A detailed description of the categories of personal information we collect and how we use such personal information is provided above in Section 2 (Information We Collect About You), Section 3 ( Information We Collect From Expert Contributors), Section 4 (How We Collect Information About You), and Section 5 (How We Use Your Information). Section 6 (Disclosure of Your Information to Third Parties) and Section 7 (Choices About How We Use and Disclose Your Information) describe the categories of third parties with whom we share personal information, the types of information shared, and the purposes for such disclosures. Snorkel AI does not and will not use facial recognition or identification technology in providing you with any Services. Snorkel AI does not store any Biometric Information and therefore cannot disclose or disseminate any biometric data to any third party for any promotional purposes.
  • Disclosure of Personal Information We Collect About You. You have the right to request we disclose to you free of charge the following information covering the 12 months preceding your request:
    • The categories of personal information we have collected about you;
    • The categories of sources from which the personal information is collected;
    • Our business or commercial purpose for collecting or selling personal information;
    • The categories of third parties with whom we share personal information, if any; and
    • The specific pieces of personal information we have collected about you.
  • Disclosure of Personal Information Sold or Used for a Business Purpose. In connection with any personal information we may sell or disclose to a third party for a business purpose, you have the right to know:
    • The categories of personal information about you that we sold and the categories of third parties to whom the personal information was sold; and
    • The categories of personal information that we disclosed about you for a business purpose.
  • Opt-Out. You have the right under the CCPA and certain other privacy and data protection laws, as applicable, to opt-out of the sale of your personal information. To opt-out of the sale of your personal information, contact us at privacy@snorkel.ai. Note that we do not currently sell personal information.
  • Correct Inaccurate Personal Information. You have the right to correct incomplete or inaccurate personal information.
  • Deletion. Subject to certain exceptions set out below, on receipt of a verifiable request from you, you have the right to request that we:
    • Delete your personal information from our records; and
    • Direct any service providers to delete your personal information from their records.
  • Please note that we may not delete your personal information if it is necessary to:
    • Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;
    • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;
    • Debug to identify and repair errors that impair existing intended functionality;
    • Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;
    • Comply with the California Electronic Communications Privacy Act;
    • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent;
    • Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;
    • Comply with an existing legal obligation; or
    • Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.
  • Limit Sensitive Personal Information. You have the right under the CPRA to request that we limit the use of your sensitive personal information to only that which is necessary for providing products or services to consumers. Under the CPRA, the “Sensitive Data” categories include:
    • Social Security numbers (SSNs)
    • Driver’s license
    • Financial account or card numbers
    • Precise geolocation
    • Racial and ethnic characteristics
    • Religious and philosophical beliefs
    • Union membership
    • Contents of mail, email, and text messages
    • Genetic and biometric data
  • Protection Against Discrimination. You have the right to not be discriminated against by us because you exercised any of your rights under the CCPA. This means we cannot, among other things:
    • Deny goods or services to you;
    • Charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;
    • Provide a different level or quality of goods or services to you; or
    • Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

Please note that we are not required to: retain any personal information about you that was collected for a single one-time transaction if, in the ordinary course of business, that information about you is not retained; reidentify or otherwise link any data that, in the ordinary course of business, is not maintained in a manner that would be considered personal information; or provide the personal information to you more than twice in a 12-month period.

We may charge a different price or rate or provide a different level or quality of services to you, if that difference is reasonably related to the value provided to our business by your personal information.

We will work to process all verified requests within 45 days. If we need an extension for up to an additional 45 days in order to process your request, we will provide you with an explanation for the delay.

9. Additional U.S. Privacy Rights

If you are a resident of Virginia, Colorado, Connecticut, Utah, or other states with comprehensive privacy laws, you may have the following rights under applicable state law:

  • Request confirmation that we are processing your personal information.
  • Request access to a copy of your personal information in a portable and readily-usable format.
  • Request that we edit or correct your personal information at any time.
  • Request that we delete your personal information, unless an exception applies. If we delete your personal information, we might not be able to provide you with the Services.
  • Request to opt-out of targeted advertising (where we engage in such activities, which is currently limited).
  • Request to opt-out of profiling in furtherance of automated decision-making (note: we do not currently engage in such processing).
  • To the extent our use of your personal information constitutes “selling” or “sharing” under applicable data privacy law, request that we not sell or share your personal information to third parties.
  • We will not process your sensitive personal information without your consent. You may also request to opt-out of our use of your sensitive personal information.
  • Be free from discrimination related to your exercise of any of your state privacy rights.

10. Additional Rights for Individuals Located in the EEA, Switzerland, or the UK

If you are located in the EEA, Switzerland, or the UK, we process your personal information based on the following legal bases:

  • Contract performance (for customer relationships)
  • Legitimate interests (for business operations and website analytics)
  • Legal compliance (for regulatory obligations)
  • Consent (where specifically obtained)

You have the following rights:

  • Access - request access to your personal information
  • Correction - request correction of inaccurate personal information
  • Erasure - request deletion of your personal information
  • Portability - request to receive your personal information in a portable format or transfer it to another controller
  • Object - request to object to processing of your personal information
  • Restriction - request to restrict processing of your personal information
  • Consent withdrawal - withdraw consent where processing is based on consent

You have the right to request to object to or restrict the processing of your personal information. If our processing of your personal data is based on your consent, you may withdraw that consent without impacting the lawfulness of processing based on your consent before its withdrawal. You may exercise these rights by contacting us at privacy@snorkel.ai. Individuals located in the EEA, Switzerland, or UK may also have the right to lodge a complaint with an EEA, Swiss, or UK supervisory authority, as applicable.

Cross-Border Data Transfers

If we transfer your personal information outside the EEA, Switzerland, or UK, we ensure appropriate safeguards are in place, including Standard Contractual Clauses approved by the European Commission or other legally recognized transfer mechanisms.

11. Exercising Your Data Rights

We are legally obligated to verify your identity when you submit a privacy rights request. We may request additional information from you to verify your identity. If we are unable to confirm your identity, we may refuse your rights request.

You may use an authorized agent to submit a privacy rights request on your behalf. If you do so, the authorized agent must present signed written authorization to act on your behalf, and you will also be required to independently verify your own identity directly with us and confirm that you provided the authorized agent permission to submit the request. This verification process is not necessary if your authorized agent provides documentation showing power of attorney to act on your behalf.

We will work to process all verified requests within 45 days. If we need an extension for up to an additional 45 days, we will provide you with an explanation for the delay.

12. Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure, including but not limited to the following:

  • Access to the Company’s IT systems is monitored in order to detect and prevent misuse.
  • All personal information is secured on cloud-based infrastructure in a controlled, secure environment, protected from unauthorized access, use or disclosure, using appropriate physical, technical and organizational measures.
  • All personal information in production environments is encrypted at rest.
  • The Company’s security measures are continuously tested, assessed, and reviewed to ensure ongoing confidentiality, integrity, availability, and resilience of processing systems and services in connection with the processing, as well as the effectiveness of the technical and organizational measures for ensuring the security of the processing.

Notwithstanding the foregoing measures, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through the Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained in or on the Services.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

13. Data Retention

We retain personal information to achieve the purposes for which the information was collected. We will delete personal information when we no longer need it for the purposes for which it was collected. In certain cases, we may need to retain personal information for purposes required under applicable law, for tax or audit purposes, or for other lawful purposes.

14. Children Under the Age of 18

The Services are not intended for and we do not knowingly collect or process personal information from children who have not reached the age of consent under relevant data privacy laws. No one under age 18 may provide any personal information through the Services. If we learn we have collected or received personal information from a child under the age of consent pursuant to relevant data privacy laws, we will delete that information. If you believe we might have any information from or about a child who has not reached the age of consent under relevant data privacy laws, please contact us at privacy@snorkel.ai.

15. Changes to Our Privacy Policy

We reserve the right to amend this Privacy Policy at our discretion and at any time. When we make changes to this Privacy Policy, we will post the updated Privacy Policy on the Website and update the Privacy Policy’s effective date. Your continued use of the Services following the posting of changes constitutes your acceptance of such changes.
